Brethren is fascinating as a demonstration that even at the level of the highest court in the US, that was created and is intended for the purpose of objectively interpreting laws, human nature reigns supreme. It’s centered around Chief Justice Warren E Burger’s court from 1969-1975, and paints a particularly uncomfortable picture of and both his leadership ability and his legal mind, but it goes beyond any one individual.

There are several interesting cases decided during this span. To me the most notable would be a couple desegregation cases, primarily involving bussing, the Pentagon papers, Roe v Wade, and the Nixon tapes. The story this book tells involves multiple justices conspiring to rework Burger’s opinions sentences at a time, others threatening to dissent over single phrases, Burger repeatedly changing his votes just to be able to assign the majority opinion, justices telling each other, “I don’t agree with this ruling but I’m going to be the fifth vote anyways to make Justice X happy”, and all sorts of other manipulation and gamesmanship.

Ultimately you’re relying on the word of the authors, and I believe they’re fairly credible, but I can’t speak to veracity. But man, the story it tells is terrifying and this is well worth a read. ( )

I was told long ago that Bob Woodward's book on the Supreme Court was the most in-depth, behind-the-curtains look at the Supreme Court ever published. The first time I picked it up and considered reading it, I decided that it was 20 years out of date and that more up-to-date books had been published so I set it back down.

Now, almost fifty years after the events covered by this book, I looked at it again and found that it had suddenly become very germane to what is happening in America today. Subjects like abortion, capital punishment, civil rights, racial/gender equality, and the impact of leaked information to the press were issues that resonated through the halls of the court as much then as they do now. In addition, the tension between the liberal and conservative wings of the court was, if anything, even more prevalent that it is now.

If you are at all interested in how decisions are arrived at by the Supreme Court, I highly recommend this book. ( )

Bár Toobin könyvét (The Nine: Inside the Secret World of the Supreme Court) korábban olvastam, és óhatatlanul hozzá hasonlítottam ezt a könyvet, Woodward and Armstong könyve jóval korábban íródott, az amerikai Legfelsőbb Bíróság belső működését 1969-tól 1976-ig bemutató könyv még a 70-es évek végén megjelent. Itt is igaz, hogy elég nehezen ellenőrizhető, hogy mennyire pontos a leírás, hiszen a Legfelsőbb Bíróság eléggé titkolózva működik, de amennyire tudom általános vélemény szerint elég pontos a könyv.

Az egyes ügyek bemutatása mellett, itt is bemutatja a könyv az új bírák kiválasztásának folyamatát, kezdetnek rögtön azt, miként választja ki a lemondott Warren helyett Burgert a főbírónak Nixon. Itt rögtön érződik, hogy Nixont nagyon nem szeretik a szerzők, ami nem túl nagy meglepetés, tekintve, hogy Woodward (Carl Bernsteinnel) robbantotta ki a Watergate-et.

A legtöbb bíróról alapvetően pozitív a kép, többekről vegyesen olvashatunk pozitív és negatív dolgokat, pl. Thurgood Marshallt elég lustának mutatják be, de megemlítik, milyen sok ügyet nyert meg (még mielőtt bíró lett) a Legfelsőbb Bíróságon, az egyetlen kivétel pont a főbíró Burger aki minden szempontból negatívnak tűnik. Mind szakmailag mind emberileg alkalmatlannak tűnik a feladatra.

Ha nem is annyira mint A The Nine, azért ez a könyv is kissé elfogultnak tűnik a liberálisok irányába, folyamatosan azért aggódik, hogy a Warren által elérd eredményeket a Nixon által kinevezett bírók tönkreteszik. Fura, hogy pont a két legfontosabb ügyben nem ez történik. Az abortuszt pont ez a bíróság legalizálta (Roe v. Wade) többségben konzervatív bírák szavazatával, a Nixon által kinevezett Blackmun vezetésével. A Watergate botránynál (United States v. Nixon) pedig egyöntetúen (8-0, Rehnquist érintettség miatt nem szavazott) döntöttek úgy, hogy Nixonnak át kell adnia a fehér házi hangszalagokat. Nixon 16 nap múlva lemondott.

Ami számomra meglepő volt a könyvben az az, hogy milyen összevissza döntenek a bírák. Az teljesen rendben van, hogy valaki megváltoztatja a véleményét, miután egy másik bíró elemzését elolvassa, de hogy pl. Muhammad Ali ügyében (Cassius Clay v. United States) először úgy tűnt, hogy Ali veszít 5-3 arányban, majd 4-4 lett (szintén vereség számára), de aztán a végén inkább 8-0-ra nyert az nem igazán növeli a jogbiztonságot. ( )

More or less a history of the first few years of the Burger Court, from 1969 to 1975. Warren Burger tends to be looked down upon by many, but this book goes after him with a machine-gun. Perhaps surprisingly, William Rehnquist comes off fairly well. Which is unusual, as the group of justices altogether come across as a squabbling, self-centered, petulant batch of schoolboys that would disgrace a first-grade lunchroom. If anything would undermine the prestige of the Court, it's this exercise in watching sausages being made. From a historical perspective, the birth of Roe v. Wade (word choice deliberate) might be the most interesting. Not particularly recommended. ( )
