Request for source of Wolfe quote

does anyone know the source of the discussion between Wolfe and 2 lawyers (i think two) in which Wolfe asks, "are you accusing me of a malum? and, if so, prohibitum or in se?"

that's the quotation as best i can recall it but i can't remember in which case it occurs.

any help would be gratefully received.
